Help at Home Terms of Service

DEFINITIONS AND INTERPRETATION

In these terms and conditions, for ease of reference, we use a variety of defined words. The definitions we use are as follows:



"Help at Home" means entity of CONNECTED HOMELESS (a charity incorporated in England and Wales with registered number 1172896) whose registered office is at 7B Edith Grove, London SW10 0LB

 

“Help at Home Area Lead” has the meaning set out below under ‘INTRODUCTION’

 

“Help at Home Central Management Platform” has the meaning set out below under ‘INTRODUCTION’


"Help at Home Services" has the meaning set out below under 'RELATIONSHIP WITH HELP AT HOME"

 

" Help at Home User App" has the meaning set out below under 'INTRODUCTION’

" Help at Home Volunteer" has the meaning set out below under 'INTRODUCTION'

" Help at Home Volunteer App" has the meaning set out below under 'INTRODUCTION’


"User" any individual who uses the Help at Home Services, whether as an Area Lead, Volunteer or as an individual seeking support or assistance from a Volunteer



INTRODUCTION
 

Help at Home has developed an app to provide a platform for individuals who are vulnerable to request assistance during times of crises and emergencies from volunteers (the ‘Help at Home User App’). Users may ask request a variety of support during crises and emergencies. Such support may include, for example, a telephone befriending service and help with daily living tasks (such as shopping).

 

Help at Home has also developed an app to provide a platform for individuals to volunteer to provide free of charge assistance to vulnerable users in response to their requests during times of crisis and emergencies (the ‘Help at Home Volunteer App’).  Volunteers would be asked to provide a variety of support to the users during crises and emergencies. Such support would include, for example, a telephone befriending service and help with daily living tasks (such as shopping). Volunteers are free to decide what support they are able to provide and when.

 

Help at Home provides access to a unique management system which will be deployed to help communities within different regional areas of England to co-ordinate support from volunteers to assist vulnerable users. In these terms and conditions, we refer to this system as the 'Help at Home Central Management Platform'.

 

The aim of the Help at Home Central Management Platform is to provide each neighbourhood the technology to be able to create their own movement for volunteer support in their own city.

 

Each area will be equipped with their own secure portal to the Help at Home Central Management Platform. Each area will then be assigned a lead person who will be able to approve volunteer applications and also manage user support requests for volunteers for that particular region using the Help at Home Central Management Platform.

The technology to provide the Help at Home Central Management Platform as described above is produced by Help at Home and then deployed to individual neighbourhoods. The Help at Home Area Leads will then be responsible for centrally managing the platform in their region and will be responsible for managing the volunteers and facilitating the requests from vulnerable users.

 

Individuals who register and are accepted as an area lead via the Help at Home Volunteer App, are referred to in these terms and conditions as a ‘Help at Home Area Lead’.

Individuals who register and are accepted as a volunteer via the Help at Home Volunteer App, are referred to in these terms and conditions as a 'Help at Home Volunteer'.

Individuals who use any of the Help at Home Services (as defined), are referred to in these terms and conditions as 'Users'. This word includes Help at Home Volunteers who use the Help at Home Services and members of the public who use the Help at Home User App to obtain support or assistance.



PURPOSE OF THESE TERMS AND CONDITIONS

The purpose of these terms and conditions is to set out important information for Help at Home Volunteers and Users.

This includes information about:

Rights, obligations and rules that apply to Help at Home Area Leads;

Rights, obligations and rules that apply to Help at Home Area Volunteers;
Rights, obligations and rules which apply to Users.

 RELATIONSHIP WITH HELP AT HOME

This section applies to Help at Home Area Leads and Help at Home Volunteers

Help at Home is responsible for producing and developing the technology to run the Help at Home Central Management Platform which will then be provided to the Help at Home Area Leads. The platform will be managed centrally by the Help at Home Area Leads and each will have responsibility of overseeing, managing and running the volunteering system.


In addition to these terms and conditions, various other rules and terms will apply to you as a Help at Home Area Lead/ Volunteer. These are set out in the following documents: (i) Help at Home’s ‘Volunteer Starter pack’ (which is available on the Connected Homeless/Help at Home website) and (ii) Help at Home’s privacy policies and notices (which are also available on the Connected Homeless/ Help at Home website). Together these documents are referred to in these terms and conditions as the Help at Home Service Documents and they apply to you as amended from time to time by Help at Home.

By submitting your application to register as a Help at Home Area Lead/ Volunteer you agree that you have seen, read and understood the role of a Help at Home Area Lead/ Volunteer, as set out in the Help at Home Service Documents and agree to observe at all times the provisions set out in them.

In particular, you agree that all support and assistance provided by you as a Help at Home Area Lead/ Volunteer will be provided free of charge.

RELATIONSHIP WITH HELP AT HOME

This section applies to all Users

In these terms and conditions, we refer to apps and systems owned and run by Help at Home (including the Help at Home Central Management Platform, the Help at Home User App and the Help at Home Volunteer App) as the 'Help at Home Services'.

Your use of the Help at Home Services will mean that you will have a contractual relationship with Help at Home. Help at Home gives you permission to use the Help at Home services and in return, you are required to agree to certain terms of use and privacy information.

By using and/or downloading any Help at Home Services ( including using Help at Home's technology to complete an application to become a Help at Home Area Lead/ Volunteer) you are agreeing to comply with and be bound by the terms of use and privacy information set out below. If you disagree with any part of the terms and conditions of use or privacy information, please do not use the Help at Home Services.

TERMS AND CONDITIONS OF USE RELATING TO THE HELP AT HOME SERVICES

This section applies to all Users.

YOUR ATTENTION IS DRAWN TO THE FACT THAT THIS SECTION CONTAINS TERMS WHICH EXCLUDE AND/OR LIMIT THE LIABILITY OF HELP AT HOME

Additional information about the Help at Home Services

The Help at Home User App and the Help at Home Volunteer App together with the  Help at Home Central Management Platform are tools that utilise the latest in App development.

 

The Help at Home User App and the Help at Home Volunteer App has been developed by Help at Home for the purposes described under 'INTRODUCTION' and in particular to facilitate a volunteer response by connecting certain members of the public who, as a result of the UK COVID-19 pandemic, wish to receive voluntary assistance, with a suitable Help at Home Volunteer. Help at Home is providing the technology enabling the Help at Home Area Leads and Help at Home Volunteers to work together to allow them to facilitate their own regional response to the pandemic.



Information about risk and liability if you use the Help at Home Services

The use of the Help at Home Services is entirely at your own risk, for which Help at Home shall not be liable.

The content on any Help at Home app is for your general information and use only. Such content is subject to change without notice.



Help at Home does not provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the Help at Home apps for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and Help at Home expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Other than the material provided by Help at Home to support Help at Home Area Lead/ Volunteer registration, your use of any information on the Help at Home website or apps (including the Help at Home User App and the Help at Home Volunteer App) is entirely at your own risk. Help at Home shall not be liable for such use.

It shall be your own responsibility to ensure that any products, services or information available through Help at Home’s website and apps meet your specific requirements.

Help at Home’s website contains material which is owned by Connected Homeless. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

Unauthorised use of any of the Help at Home Services may give rise to a claim for damages and/or be a criminal offence.

Important privacy information relating to Help at Home's use of your personal data can be found below under ‘DATA AND PRIVACY POLICY’  on Connected Homeless/ Help at Home's website.

COPYRIGHT

Ownership of the copyright in all content contained within the Help at Home Services belongs to Connected Homeless. You must not re-use or copy such content without permission. If you wish to reuse any of Help at Home Service's content, please contact Connected Homeless first to obtain permission. Any permission is granted at the discretion of Connected Homeless.

 

 

 

 

 


Use of the Help at Home Volunteer App

Permission to use the Help at Home Volunteer App will be limited to Help at Home Area Leads and Help at Home Volunteers. Those who have permission to use the Help at Home Volunteer App by the Help at Home Area Leads will be issued with login details and asked to set up passwords. You are required to keep your login details and passwords secure and not share them with other persons.

USE OF PERSONAL DATA

This section applies to Help at Home Area Leads, Help at Home Volunteers and Users

Please note that the privacy information in this section is provided in addition to the information about use of your personal data set out in Help at Home’s privacy notices and policies. You can find these documents on Connected Homeless/ Help at Home’s website. It is important that you read these documents carefully so that you understand fully the ways in which Help at Home will use your personal data.

Your personal data will be stored on Help at Home’s servers. Help at Home will ensure that your personal data is stored securely and is only used in the ways and for the purposes described in Help at Home’s privacy notice and policies. In particular, Help at Home will not sell, distribute or lease your personal data to third parties unless you have given your express consent to them doing so.

Help at Home will be the controller and processor of any personal data which you submit via the Help at Home Volunteer App.

Personal data that you submit via the Help at Home User App and the Help at Home Volunteer App will be shared with the Help at Home Area Lead for the purpose of co-ordinating and providing the volunteer service described above under 'INTRODUCTION'.

Under data protection law, individuals have a number of important rights. This includes the right to request information from organisations about the personal data they hold about you and how they use that personal data. Help at Home’s privacy notices and policies contain further information about how you can exercise your rights under data protection law. You can also find additional information on the ICO website.

Please also contact Help at Home in this way if you believe that any information Help at Home is holding about you is incorrect or incomplete. Help at Home will correct any personal data found to be incorrect or incomplete as soon as possible after it has been brought to their attention.



 LIABILITY

This section applies to Help at Home Area Leads, Help at Home Volunteers and Users

PLEASE READ OVER THIS SECTION CAREFULLY AS IT SETS OUT TERMS RELATING TO THE LIABILITY OF USERS AND HELP AT HOME AREA LEADS AND VOLUNTEERS AND THE LIABILITY OF HELP AT HOME

Help at Home Area Leads and Help at Home Volunteers undertake voluntary acts in good faith as members of the public undertaking voluntary action. Help at Home Area Leads and Help at Home Volunteers will not have any liability for loss or damage of any kind resulting from acts or omissions undertaken by them in their capacity as Help at Home Volunteers. Help at Home Volunteers will also not incur any liability if they are unable to provide support or assistance. This exclusion of liability does not, however apply to any criminal liability.

Help at Home Area Leads and Help at Home Volunteers are, however, expected to act in accordance with the instructions issued by Help at Home from time to time. You may be removed as a Help at Home Area Lead and a Help at Home Volunteer and your permission to access the Help at Home Volunteer App removed if you do not act in accordance with such instructions.

 

Help at Home Volunteers must keep their Help at Home Area Leads informed if they develop any symptoms of COVID-19 such as fever, sore throat or cough and if they do, then they agree to cease volunteering and start their period of self-isolation.

 

Help at Home Volunteers will have to cease volunteering if asked to, at any point, by the Help at Home Area Lead.

 

Help at Home Users must observe the latest NHS safety guidelines at all times which can be found at: https://www.nhs.uk/conditions/coronavirus-covid-19/

 

Whilst Help at Home may provide Help at Home Users with best practice health and safety guidelines based on the NHS guidelines as above, it is accepted by all Help at Home Users that Help at Home are not medical professionals and have no medical expertise whatsoever.

Help at Home Users are solely responsible for their own welfare, and you accept and acknowledge any and all risks of Personal injury or illness, Emotional Trauma, Property damage and Death that may occur as a result of you participating in Help at Home Services.

 

Help at Users acknowledge and accept the responsibilities and risks associated with providing/accepting support to vulnerable users/Volunteers respectively. Such support can involve a certain degree of risk, and this is fully accepted by and solely assumed by the Help at Home Users. Therefore, Help at Home is not liable, to the maximum extent of the law, for any loss or harm the Help at Home Users or associates may suffer, including but not limited to loss caused by: Personal Injury, Illness or Disease, Safety, Damage to or loss of property, Emotional Injury or Death.



As stated above, Help at Home cannot be held liable for any injury or misadventure that occurs to Help at Home Users as a result of their use of the Help at Home Services. This includes but is not limited to issues relating to the malfunction of any Help at Home Services and/or technical matters relating to any Help at Home apps (including the Help at Home User App and the Help at Home Volunteer App), GPS matters or location inaccuracies.

Help at Home does not seek financial remuneration from use of the Help at Home Services from either Help at Home Area Leads or Help at Home Volunteers or members of the public receiving voluntary support from a Help at Home Volunteer.

 

By agreeing to become a Help at Home User you confirm that you have read and agree to our terms & you are waiving any Liability that, amongst other things:

  • Forever releases us, our owners, our directors and any persons or groups associated to us of all liability;

  • Forever signifies that you are waiving any claims against us, our owners, our directors and any persons or groups associated to us, and expressly assuming all risks associated with participating in the Help at Home Services.


GOVERNING LAW AND JURISDICTION

These terms and conditions are subject to the laws of England and Wales. Any claims or disputes arising in connection with these terms and conditions will be subject to the exclusive jurisdiction of the courts of England and Wales.

ACCEPTANCE

By using the Help at Home Services and/or registering as a Help at Home Area Lead or Volunteer, you are deemed to accept these terms and conditions and agree to act in accordance with them.
